Reward Program Terms & Conditions

MEMBERSHIP & ELIGIBILITY

The Reward Program ("Program") is a reward program offered by Brown Brothers Milawa Vineyards Pty. Limited (ABN 56 005 349 235) (Brown Family Wine Group, BFWG, Brown Family Wines, we, us, or our) to customers of www.brownfamilywines.com.au (“Brown Family Wines”). Membership to the Program ("Membership") is limited to individuals only and is limited to one account per individual (a “Member”). Brown family members, employees, officers, directors, agents and representatives of BFWG and its affiliates are not eligible for Membership but may be benefit from to time from certain promotions upon BFWG discretion. You must be age 18 years or older or of legal drinking age in your country of residence to be eligible for Membership. In accessing the Reward Program, you agree to be bound by these terms and conditions ("Terms").  Membership is linked to 1 (one) unique email address and online account. Membership cannot be transferred to anyone else.

 

EARNING PROGRAM REWARDS

Under the Program, you earn one (1) Brownie point (“Point”) at the rate specified on the Rewards Program website page (“Rewards Program Page”) when you make an eligible spend on Brown Family Wines, or through any of the ways identified on our Rewards Program page (“Points Earned”). Eligible Spend is defined as an Eligible Purchase less any returns and refunds and excluding delivery charges (“Eligible Spend”). An eligible purchase is defined as a wine purchase made on Brown Family Wines, excluding the purchase of e-gift cards, gift cards, wine plans and shipping costs, and net of any discounts (“Eligible Purchase”). If, after you make an Eligible Purchase, you obtain a refund or reimbursement for any products or services purchased from BFWG, an adjustment will be made to your eligible spend for the amount refunded or reimbursed. You must provide a form of identification at the point of purchase to have any points credited to your Points Balance. The form of identification may consist of your e-mail address. 

Points are accumulated for the purpose of determining the applicable Membership Tier for each member (“Membership Tier”) and the associated benefits for that Tier that are available for use by the member (“Benefits”). Points have no cash or monetary value but can be redeemed within the Brown Family Wines checkout for a specific discount amount as listed under Points Redemption discounts (“Points Redemption Discounts”).

 

MEMBERSHIP TIER

For the purposes of determining Membership Tier, Points accumulated on and from 24 October 2023 will be valid for ONE (1) year from the date that the points were earned (“Earn Date”). For the purposes of determining membership tier, all Points will be automatically disregarded without notice on the last day of the month one year from the relevant Earn Date. To illustrate, Points which are earned on an order placed on the 10th of November 2023 will automatically expire for the purposes of determining Membership Tier on 10th of November 2024. For the purposes of determining Membership Tier, there shall be no extension of time for the validity period of any Points, and all expired Points cannot be reinstated.

Your Points Earned are reviewed every day, meaning if you have accrued enough Points to move up a Membership Tier, you will be upgraded in the upcoming 3 business days and you will be eligible for any benefits associated with your new Membership Tier.

We review your Membership Tier at the end of every 365 days from when you reached that Membership Tier to see if it should be adjusted to a lower level. This date is called your Anniversary Date. If you have not maintained the amount of Points Earned required to retain your Membership Tier in the 365-day period up to an Anniversary Date, we will adjust your Membership Tier level down. It is important that you keep track of your Anniversary Date if you want to maintain your Membership Tier.

Your points history can be reviewed, when logged in, on the Rewards Program Page.

 

MEMBERSHIP TIER BENEFITS

Benefits attach to respective Membership Tiers and are available for use by an eligible member during a certain period determined by us (“Benefit Period”). Benefits are not transferable and cannot be redeemed for cash or equivalent.

When you move up or down a Membership Tier, we will notify you of the Benefits available for your use via email. If you have elected not to receive emails from us, you can review your Membership Tier status at any time via the Rewards Program Page. Though Members who have opted out of receiving our email communications will not be notified directly, they will nonetheless be eligible to use the applicable Membership Tier Benefits.

Although Benefits will usually be available for use online, sometimes we may send you your Benefits directly. When you would like to redeem your Benefit online (and the terms and conditions on which the Benefit is offered allow you to do this), you must login to your online account to do this. Please note that no Benefits can be redeemed in any of our cellar doors, restaurants, events or experiences.

 

 

POINTS REDEMPTION DISCOUNTS

A members’ Points Balance is defined as their accumulated Points Earned on and from 24 October 2023, less any Points which have expired or have been redeemed for discounts (“Points Balance”). Points Earned will be able to be redeemed for discount(s) for a period of SIX (6) months from the Earn Date. If after a period of SIX (6) months from the Earn Date, Points Earned have not been redeemed for discount(s), those points will be automatically expired without notice on the last day of the month, SIX (6) months from the relevant Earn Date. To illustrate, Points which are earned on an order placed on the 10th of November 2023 will automatically expire for the purposes of redeeming for discounts on 10th of May 2024. For the purpose of redeeming points for discounts, there shall be no extension of time for the validity period of any Points, and all expired Points cannot be reinstated.

For the purposes of redeeming discounts on Brown Family Wines from a member’s Points Balance, 10 points shall have a value of $1. In order to redeem Points for discounts, a member must have created an account on Brown Family Wines. When purchasing on Brown Family Wines, the member must be logged in to their account in order to redeem Points for discounts at the checkout.

At the checkout on Brown Family Wines, a logged in member can elect to redeem from their Points Balance for any of the pre-determined discount amounts as outlined in the table below, so long as their Points Balance has the points required and their cart contains the minimum spend required.

YOUR PERSONAL INFORMATION AND PRIVACY

Our Privacy Policy sets out the ways in which we may collect, store, use and manage Your Personal Information, and the physical, electronic and security measures we will take to protect Your Personal Information. For example, BFWG uses Personal Information of prospective and actual Customers to provide them with information about events, offers, promotions, products and services which may be of interest.
By supplying us with Personal Information through our Reward Program, You accept the inherent security risk of dealing online over the internet and agree not to hold us responsible for any breach of security, unless we have breached a law or been negligent or in wilful default of our duties to You.  

 

TERMINATION OF MEMBERSHIP

If you would like to terminate your membership you can do this by calling our Customer Service team on the number on the Brown Family Wines website or using the “Contact Us” page on https://brownfamilywines.com.au/pages/contact.

We may terminate your membership without notice if you do not use your membership for a long period of time and, as a result, we believe you are no longer a Brown Family Wines customer.

We may also terminate your membership without notice if we think you have breached these Terms & Conditions.

If your membership is terminated, you will no longer be entitled to accrue any Points or redeem any Benefits.

 

CHANGES TO THESE TERMS & CONDITIONS

We keep these Terms & Conditions on the Brown Family Wines website, so it is easy for you to access them.

We try not to change these Terms & Conditions too often, but sometimes we need to. When we change these Terms & Conditions, we will put the updated version on the Brown Family Wines website straight away.

If you continue to use your membership after we change these Terms & Conditions, you will be deemed to have accepted the changed Terms & Conditions.

 

GOVERNING LAWS

The laws of Victoria, Australia, govern these Terms and Conditions and the courts of Victoria have non-exclusive jurisdiction to hear any matters arising out of or in connection with these Terms and Conditions.
